Terms and Conditions of Sale
Prices quoted in this catalog replace all previous quotes and are made subject to market changes, exhausted supply, weather conditions, or shortage beyond the control of Abraczinskas Nurseries Inc. Any quotes or prices are subject to change without notice. We reserve the right to reject all or any part of an order refunding payments made.
Abraczinskas Nurseries Inc. is solely responsible for the sale transaction and is not liable in the event of crop loss or damage caused by circumstances beyond our control. Liability ceases when trees are delivered to the carrier. If breakage occurs or if stock suffers through delay in transit, claims should be made immediately to the Transportation Company. We cannot guarantee nursery stock after delivery is made, as we have no control over soil, weather, planting, or maintenance conditions after plants leave our nursery. We will not replace plants that fail to live or thrive. No warranty is given, expressed, or implied as to the growth of our nursery stock after you receive it.
All orders are confirmed with a 25% deposit to Abraczinskas Nurseries, Inc. Balance is due upon pick up or delivery. Any unpaidpast due balance is subject to a monthly service charge of 1.5% Minimum of $2.00. We do accept most major credit cards.
All prices are F.O.B. plantations, unless otherwise stated, with a minimum delivery order of 50 B&B or 100 Cut trees. Due to the increasing demand for our cut trees we can not guarantee orders received after August 15.
It is the customers responsibility to have ample equipment and manpower on hand at the time of delivery to ensure expeditious unloading of trees. Failure to do so can incur additional charges from or by the delivering freight company at their discretion, payable to them at time of delivery.

All B&B trees and cut trees must be counted and inspected by kind and size upon delivery by a qualified responsible company representative. Any problems or discrepancies must be resolved at the time of delivery before driver leaves, by calling our office for instructions. No adjustments will be accepted after driver leaves. All trees accepted by the customer, employee or place of business must be paid in full at the time of delivery/pick-up unless pre-paid.
Seedlings, transplants and promotional packages are usually shipping via United Parcel Service. To cover this shipping and handling charge, we requirean addercharge of 15% of your total order, with a minimum charge of $15.00. All orders for seedlings, transplatns, and promotional packages require PAYMENT IN FULL before shipment is made.
Seedlings and transplants should be kept cool, moist, and out of the sun and wind until planting. Planting should be as soon as possible after receiving trees.
B&B trees - upon delivery remove baling twine, mulch in, and water as needed. Planting should be as soon as possible after receiving trees.
Cut trees should be kept out of the sun and wind. Stand trees on butts and remove the baling twine. Rotate your stock regularly.
